Position Summary
Our client, a respected law firm, is seeking an experienced Law & Motion (L&M) Appeal Attorney to support litigated CAPIC matters. This role focuses on drafting appellate briefs, motions, applications, and complex pleadings related to medical malpractice defense. The attorney will provide strategic legal analysis and drafting support throughout all phases of litigation, including pre-trial motions, trial support, and post-trial and appellate proceedings.
The ideal candidate is a highly skilled legal writer with in-depth knowledge of California trial and appellate courts and extensive experience in motion practice and appeals within medical malpractice defense.
Key ResponsibilitiesAppeals
- Designate, review, and analyze lower court records and supporting documents
- Monitor appellate dockets and deadlines
- Conduct legal research and draft persuasive appellate briefs, motions, applications, and related filings
- Advocate before appellate courts and justices
- Assist in-house and outside trial counsel in issue framing and record preservation for appeal
- Advise trial counsel and claims specialists on writ petitions
Law & Motion Support
- Draft pleadings, motions, and supporting legal documents
- Develop creative and strategic law and motion approaches
- Collaborate with claims specialists and attorneys to obtain concurrence on pleading strategy
- Provide litigation support for trials and arbitrations
- Attend court hearings and argue motions as needed
- Assist with compliance under Defense Attorney Guidelines
- Perform other related duties as assigned
Required Qualifications
- Juris Doctor (J.D.) degree from an accredited law school
- Active license to practice law in the State of California
- Proven experience drafting appellate briefs and complex law and motion pleadings
- Strong background in medical malpractice defense
- Exceptional legal research, writing, and analytical skills
- In-depth knowledge of California trial and appellate court procedures
- Ability to work onsite and collaborate closely with legal teams
